1. Who we are & scope

technbyte.com is operated by Tech N Byte LLC (STE 4254, 1209 Mountain Road PL NE, Albuquerque, NM 87110, USA, Reg. No. 0008071851) and Tech N Byte LTD (111 Royal Crescent, Ilford, Essex, IG2 7JZ, UK, Company No. 14248407). Customers in the United Kingdom and European Economic Area contract with Tech N Byte LTD; all other customers contract with Tech N Byte LLC.

These terms cover use of this website and the services we sell: digital marketing and SEO plans, one-off marketing projects, software and web development, PanelOps subscriptions and AudiencePlan plans. Where a signed proposal or project agreement exists, that agreement takes priority over these terms if the two conflict.

Amazon purchases are not covered here. Orders placed through our Amazon storefronts are transactions on Amazon, governed by Amazon's Conditions of Use and Sale.

2. Services & orders

The services and prices on our Pricing page describe what each plan includes. An order is confirmed when you accept a written quote or order summary from us and make the first payment. The quote sets out the scope, deliverables, timeline and price for your order.

Custom software, website and web application work described on our Services page is always quoted per project, and is governed by the proposal or project agreement for that engagement.

We don't promise specific search rankings, traffic, follower numbers or sales, because search engines, platforms and your market decide those. We do commit to delivering the work listed in your plan or quote.

3. Pricing & payment

  • Prices are shown in US dollars and exclude any sales tax or VAT that applies. UK customers are invoiced in pounds sterling by Tech N Byte LTD at the price shown on their quote.
  • Monthly plans are billed in advance. One-off projects are paid upfront, or 50% upfront and 50% on delivery for projects over $1,000. Development projects are paid by milestone.
  • Card payments are processed by our payment provider. We don't see or store your full card number.
  • Advertising budgets are paid by you directly to the ad platform and are not part of our fees.
  • If a payment fails, we'll let you know and pause work until it's resolved. We change prices for existing monthly customers only with at least 30 days' written notice.

4. Subscriptions & Cancellation

Monthly plans, PanelOps subscriptions and AudiencePlan plans renew automatically each month until cancelled. You can cancel at any time before your next billing date and won't be charged again. Cancellation, refund and delivery rules are set out in full in our Refund & Cancellation Policy, which forms part of these terms. 5. Acceptable Use

You agree not to scrape this website, attempt to disrupt it, or misuse the contact form (including automated or bulk submissions).

When you use our services or PanelOps, you also agree not to use them to:

  • send unsolicited bulk messages, message contacts who haven't opted in, or use bought or scraped contact lists;
  • sell or promote fake engagement, including followers, likes, views, streams or reviews;
  • break WhatsApp's, Meta's, Google's or any other platform's terms or commerce policies;
  • promote gambling, adult content, weapons, drugs, counterfeit goods, or get-rich-quick, pyramid or other deceptive financial schemes;
  • harass anyone, impersonate a person or business, or collect personal data unlawfully;
  • do anything illegal in the country where you or your customers are located.

We turn down work that falls into these categories. If an account or project breaks these rules, we may suspend or end it without a refund for the current period, and we'll tell you why.

6. Intellectual property

The Tech N Byte name and logo, the content of this website, and the names of our products (PanelOps, AudiencePlan, and our POS, restaurant, inventory, accounting, money management and appointment and queue management software) belong to Tech N Byte LLC and Tech N Byte LTD. You may not copy, reproduce or reuse them without our written permission.

Once you've paid for it, the content, designs and code we create specifically for you belong to you, unless your project agreement says otherwise. We keep ownership of our own tools, templates and pre-existing code, and give you a licence to use any of it included in your deliverables.

7. Disclaimers & limitation of liability

We keep the information on this website accurate to the best of our knowledge, but we make no warranty that it is complete or error-free at all times. Links to external sites, including Amazon, panelops.net and audienceplan.com, are provided for convenience.

To the extent permitted by law, our total liability for any claim connected with a service is limited to the fees you paid for that service in the 3 months before the claim, and we are not liable for indirect or consequential losses. This does not limit any liability that cannot be excluded by law.

8. Governing law

If you contract with Tech N Byte LLC, these terms are governed by the laws of the State of New Mexico, USA. If you contract with Tech N Byte LTD, they are governed by the laws of England and Wales. If you're a consumer, you also keep any protections given by the law of the country where you live.

9. Changes to these terms & contact

We may update these terms as our services change; the "Last updated" date above shows the latest revision. Changes don't apply to orders already confirmed. Questions about these terms can be sent to [email protected].
